Tesla did not take that route. Why the timing is not an accident

Who gains and who loses

The losers start with regulatory predictability. If self certification can be extended to a vehicle that omits the equipment the standards require, every manufacturer will ask why it should file for an exemption. The counter case

The assessment that this resolves by negotiation could be wrong if the agency decides the precedent matters more than the outcome. A finding that the Cybercab is noncompliant would, in principle, require a stop sale and a remedy for vehicles already deployed, and a remedy for a car with no steering wheel is not a software update. It is also possible that Tesla's theory is stronger than it looks: the standards' applicability language has never been tested against a vehicle designed with no driving position, and a court might read them narrowly. Finally, the political weather favors Tesla for now. A rule change that removes manual control requirements would moot the query before it concludes, in which case the audit is a formality and the assessment above is too cautious.

What to watch
